All images on this website, including artwork, are the exclusive property of Anthony Carey and are protected by copyright law. The artist retains the perpetual right to use digitally recorded images of any purchased artwork for any purpose, including but not limited to promotional activities and the creation of reproductions for financial gain.
2. Misrepresentation and Artwork Accuracy
While every effort is made to ensure the images displayed on www.anthonycareyart.com are accurate representations of the original artwork, please be aware of the following:
- Texture and Color Variations: The texture and materials used in the artwork may cause slight variations in color or appearance when viewed digitally. These variations are not defects but are an intentional part of the artist’s creative process.
- Screen Display Differences: Colors on digital screens may differ from the original artwork due to individual screen settings and lighting conditions. These minor discrepancies do not constitute grounds for returns based on misrepresentation.
- Video Preview: If needed, you may request a short video of the artwork for a more detailed view before purchase.
- Minor Discrepancies: Minor blemishes or variations inherent to the artwork are considered part of the handmade nature of the work and do not constitute significant defects.
3. Privacy and Data Protection

4. Purchases
- You do not need to create an account to make purchases.
- All major credit cards, Apple Pay, Google Pay, and PayPal are accepted for transactions.
- We reserve the right to refuse any order for any reason. If an order is refused, the customer will be notified promptly.
5. Order Process
Upon placing an order, a confirmation email will be sent to the email address provided during the purchase. Orders will be processed within 3 business days.
6. Pricing and Availability
Prices and product availability are subject to change without notice. We are not obligated to notify customers in advance of such changes.
7. Shipping and Handling
- Shipping: We offer free shipping within Ireland, with variable shipping rates for the rest of the world.
- Delivery Time: Estimated delivery time is up to 21 days, depending on the destination.
- Handling: Orders will be handled within 3 business days after confirmation.
8. Returns and Refunds
- Returns: Returns are accepted within 14 days of the delivery date. The artwork must be returned in its original condition and packaging, using tracked and insured shipping.
- Return Shipping Costs: Customers are responsible for return shipping costs.
- Refunds: For returns made after the 14-day cancellation period, a 15% restocking fee will apply. Initial shipping costs will also be deducted from the refund. Refunds will be processed after the item is received and confirmed to be in its original condition.
9. Cancellations and Cooling-Off Period
In accordance with EU consumer protection laws, customers have the right to cancel their order within 14 days of receiving the artwork without providing a reason. To exercise this right, you must notify us via the Contact Form. All returns must follow the process outlined in our Returns and Refunds policy.
No restocking fee will be applied to cancellations made within the statutory 14-day cooling-off period under Irish and EU consumer law.
10. ARTWORK RESALE & FIRST RIGHT OF REFUSAL
Buyers are kindly requested to notify Anthony Carey Art if they intend to resell a purchased artwork, especially within the first three (3) years of ownership. This helps the artist maintain a record of provenance and the ongoing story of the work.
Where possible, Anthony Carey requests the opportunity to reacquire the piece under the same terms offered to any third party (first right of refusal).
While this is not a legal obligation, it is a professional courtesy that supports the integrity and legacy of the artwork..
11. Taxes and Import Duties
For international orders, buyers are responsible for any taxes, duties, or customs fees that may be applicable to the shipment of artwork. These charges are not included in the artwork price or shipping fees.
12. Certificate of Authenticity
Each artwork sold through www.anthonycareyart.com will include a signed certificate of authenticity verifying the originality of the artwork.
13. ATTRIBUTION & PROVENANCE
Buyers are encouraged to retain the artist’s name alongside the artwork title and year when reselling, exhibiting, or loaning works. This supports accurate provenance and honours the original creator’s authorship. When guest-authored texts or collaborative content appears on this site, those authors retain their copyright, and their work is included with permission. Requests for reuse or reproduction of such content must be directed to the respective author. If a work is loaned to a public venue or featured in media, credit should read:
“Anthony Carey, title of work, year.”
14. Limitation of Liability
To the fullest extent permitted by law, Anthony Carey Art is not liable for any direct, indirect, incidental, or consequential damages arising from:
- Shipping Delays: Delays caused by third-party carriers, customs processes, or other factors beyond our control.
- Website Errors: Technical issues, inaccuracies, or problems with the website.
- Third-Party Links: Content, functionality, or security of third-party websites linked from www.anthonycareyart.com.
- Product Variations: Minor variations in color or texture due to screen settings or the handmade nature of the artwork.
Our liability for any claim related to a purchase is limited to the amount paid for the specific artwork. In no event shall our liability exceed the purchase price of the artwork.
15. Force Majeure
We are not liable for any failure or delay in performance resulting from circumstances beyond our control, including but not limited to natural disasters, pandemics, war, or governmental actions. In the event of such delays, we will notify customers of any changes in delivery or service.
16. Indemnification
By using this website, you agree to indemnify, defend, and hold harmless Anthony Carey Art and its affiliates from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the website or breach of these terms.
