TERMS AND CONDITIONS

These Terms and Conditions apply to the use of www.anthonycareyart.com and to purchases made directly from Anthony Carey Art through the website.

Please read them before placing an order. Nothing in these Terms and Conditions affects any rights you may have under applicable consumer law.

References in these Terms and Conditions to “Anthony Carey Art,” “Anthony Carey,” “the artist,” “we,” “us” or “our” refer to Anthony Carey trading as Anthony Carey Art.

2. SCOPE OF THESE TERMS

These Terms and Conditions apply to:

  • original paintings and other original artworks;
  • limited-edition prints;
  • other products offered through the website;
  • use of the website and its content; and
  • orders agreed directly with Anthony Carey Art by email or another written method, unless different terms are expressly agreed in writing.

You must be at least 18 years old, or otherwise legally capable of entering into a contract, to place an order.

If you are purchasing as a consumer, your statutory consumer rights remain fully applicable and take priority over any provision of these Terms and Conditions that conflicts with those rights.

3. ARTWORK DESCRIPTIONS AND IMAGES

Every reasonable effort is made to describe artworks accurately and provide clear photographs.

Original artworks are handmade and may contain visible brushwork, plaster, texture, layering, exposed materials, irregular edges and other variations resulting from the artist’s materials and working process. These characteristics form part of the artwork and are not necessarily faults.

Colours and tonal values may appear differently depending on the customer’s screen settings, device, lighting and viewing conditions. Photographs may not reproduce the full depth, surface or texture of an original artwork.

Measurements are approximate. Minor differences may occur, particularly where dimensions include textured or irregular surfaces.

Customers may request additional photographs or a short video of an original artwork before purchasing by contacting hello@anthonycareyart.com.

Nothing in this section limits a customer’s rights where an artwork is faulty, damaged or materially different from its description.

4. AVAILABILITY

Original artworks are unique and are subject to prior sale. An artwork may also be displayed, offered or represented through another venue, exhibition or gallery.

If an original artwork is sold elsewhere before the website can be updated, any website order for that work will be cancelled and all money paid will be refunded promptly using the original payment method.

Limited-edition prints are subject to the stated edition size. Once an edition has been fully sold, no further prints will be produced in that edition.

We may withdraw a product from sale or correct an obvious pricing or descriptive error before accepting an order.

5. PRICES

Prices are displayed in euro unless otherwise stated.

The price shown on the product page at the time an order is placed applies to that order, subject to the correction of an obvious error.

Any applicable delivery charge will be shown at or before checkout. International customers may also be responsible for import VAT, customs duties, brokerage charges or other charges imposed by the destination country.

Prices and availability may change, but changes will not affect an order that has already been accepted.

6. PLACING AN ORDER AND CONTRACT FORMATION

Products may be purchased through the online shop without creating a customer account.

After an order is placed, an automated email may be sent acknowledging receipt. This acknowledgment does not necessarily mean that the order has been accepted.

A contract is formed when Anthony Carey Art confirms acceptance of the order or dispatches the order, whichever occurs first.

Before accepting an order, we may need to:

  • confirm that the artwork remains available;
  • verify payment or delivery information;
  • obtain a confirmed international delivery quotation in exceptional cases; or
  • contact the customer about an apparent error in the order.

We reserve the right to refuse or cancel an order for a legitimate reason, including unavailability, suspected fraud, inability to deliver to the supplied address or an obvious pricing error. If payment has already been received, it will be refunded promptly.

7. PAYMENT AND CHECKOUT SERVICES

The online shop and checkout are operated using Ecwid by Lightspeed.

Payments are processed by the payment method selected at checkout:

  • Stripe processes credit and debit card payments and payments made through Apple Pay, Google Pay or Link.
  • PayPal processes payments made through PayPal Checkout.

Anthony Carey Art does not directly receive or store complete credit- or debit-card details. Payment providers may carry out security, authentication and fraud-prevention checks before approving a transaction.

Payment must be received in full before an order is dispatched, unless a different arrangement has been expressly agreed in writing.

8. DELIVERY CHARGES

Delivery within Ireland is free unless otherwise stated on the product page.

International delivery charges are calculated as a proportion of the artwork price or according to the delivery rate displayed at checkout. Anthony Carey Art may subsidise part of the actual cost of packaging, tracked delivery and appropriate insurance.

For particularly large, heavy, fragile or difficult-to-ship works, a confirmed delivery price may be required before an order is accepted. If the customer does not wish to proceed after receiving the total price, any payment already taken will be refunded.

International delivery charges paid through the website do not include customs duties, import taxes, local handling charges or brokerage fees imposed by the destination country or delivery provider.

9. DISPATCH AND DELIVERY TIMES

Original artworks that are immediately available are normally prepared for dispatch within three business days, unless otherwise stated.

Limited-edition prints may be produced to order by a specialist fine-art printer. Where a product page states a production period, please allow that period for the print to reach the artist’s studio, after which it will be checked, signed, numbered and prepared for dispatch.

Any production or delivery time shown on the website is an estimate unless expressly agreed as a fixed deadline. Delivery times may be affected by the destination, customs clearance, printing schedules and circumstances outside our reasonable control.

Where the product description specifies a lead time that may result in delivery taking longer than 30 days, the customer accepts that stated delivery period when placing the order.

If an order is delayed materially, we will contact the customer. Customers retain any applicable legal rights relating to delayed or failed delivery.

Customers are responsible for providing a complete and accurate delivery address. We are not responsible for additional delivery costs arising from an incorrect or incomplete address supplied by the customer.

10. PACKAGING, DELIVERY AND INSPECTION

Artworks are packaged with reasonable care appropriate to their size, materials and destination.

The customer should inspect the external packaging and the artwork as soon as reasonably possible after delivery.

If an artwork or print arrives damaged, the customer should contact hello@anthonycareyart.com promptly and provide:

  • the order number;
  • photographs of the external packaging;
  • photographs of any internal packaging;
  • clear photographs of the damage; and
  • any relevant information supplied by the carrier.

Customers should retain all packaging while a damage claim is being considered. Disposing of the packaging may affect the ability to pursue a claim with the delivery provider, although this does not remove the customer’s statutory rights.

Risk of loss or damage passes to a consumer when the customer, or a person nominated by the customer other than the carrier, takes physical possession of the order.

11. RIGHT TO CANCEL AN ONLINE PURCHASE

Where the statutory cancellation right applies, a consumer may cancel an online purchase without giving a reason from the time the order is placed until 14 days after the day on which the customer, or a person nominated by the customer, receives the goods.

If an order contains multiple goods delivered separately, the cancellation period begins when the final item is received.

How to cancel

The simplest way to cancel an order is to email:

The email should state clearly that you wish to cancel the order and should include:

  • your name;
  • your order number; and
  • the artwork or product being cancelled.

You do not have to use the model cancellation form below, although you may use it if you prefer. A clear email or message sent through the website Contact Form is sufficient.

Your cancellation is valid provided the notification is sent before the cancellation period expires.

After receiving your cancellation notice, Anthony Carey Art will reply with the appropriate return address and instructions for safely returning the artwork. Please do not send an artwork back before receiving these instructions.

No restocking or administration fee will be charged when a statutory cancellation right is exercised.

12. EXCEPTIONS TO THE CANCELLATION RIGHT

The statutory change-of-mind cancellation right may not apply to goods that are made to the customer’s specifications or are clearly personalised, including qualifying commissioned or personalised artworks.

This exception will be identified before the order is placed where it applies.

An existing original artwork is not treated as personalised merely because it is unique. A standard limited-edition print is not treated as personalised merely because it is produced after an order is placed, signed or assigned an edition number.

The exclusion of a change-of-mind cancellation right does not affect a customer’s rights if personalised or commissioned goods are faulty, damaged or not as agreed.

13. RETURNING A CHANGE-OF-MIND PURCHASE

After notifying us of a cancellation, the customer must return the order within 14 days.

Customers should contact Anthony Carey Art before arranging the return so that the correct return address and appropriate packaging and delivery requirements can be confirmed.

Unless the item is faulty, damaged or not as described, the customer is responsible for the direct cost of returning it.

The artwork should be:

  • returned in its original condition;
  • securely repackaged, preferably using the original packaging;
  • sent using a tracked delivery service;
  • insured appropriately for its value; and
  • handled with reasonable care while in the customer’s possession.

Because original artworks may be large, fragile or unsuitable for ordinary postal return, international return costs can be substantial. The cost will depend on the artwork’s size, value, packaging and location. Customers purchasing a larger work may contact us before ordering for an estimate of the likely return-delivery cost from their location.

The customer remains responsible for the returned artwork until it is received by Anthony Carey Art. We strongly recommend retaining proof of dispatch and insurance.

14. REFUNDS FOLLOWING CANCELLATION

Following a valid statutory cancellation, we will refund:

  • the purchase price; and
  • the amount paid for the least expensive standard delivery method offered for the order.

Any additional amount paid for express, enhanced or specially requested delivery does not have to be refunded.

Refunds will be made using the original payment method unless the customer expressly agrees otherwise. No separate refund fee will be charged.

We may withhold the refund until:

  • the returned goods have been received; or
  • the customer provides adequate evidence that the goods have been returned,

whichever occurs first.

A refund may be reduced to reflect any loss in value caused by handling beyond what was reasonably necessary to establish the nature, characteristics and condition of the goods. This is not an automatic restocking fee, and any deduction will reflect an actual reduction in value.

Anthony Carey Art does not offer an additional change-of-mind return period after the applicable statutory cancellation period unless otherwise agreed in writing.

Customs duties, import taxes or carrier administration charges paid directly by the customer to a customs authority, courier or other third party are not collected by Anthony Carey Art and cannot be refunded by us. The customer may need to apply separately to the relevant authority or provider.

15. FAULTY, DAMAGED OR MISDESCRIBED GOODS

All products must comply with applicable consumer law, including requirements relating to conformity, quality and correspondence with their description.

If an artwork or print is faulty, damaged on arrival or materially different from its description, the customer should contact hello@anthonycareyart.com as soon as reasonably possible.

Depending on the circumstances and the customer’s applicable legal rights, an appropriate remedy may include repair, replacement, a price reduction or refund.

Where goods are validly returned because they are faulty, damaged or not as described, Anthony Carey Art will arrange collection or reimburse reasonable return-delivery costs.

Nothing in these Terms and Conditions excludes or limits any mandatory remedy available under consumer law.

16. LIMITED-EDITION PRINTS

Limited-edition prints are produced in the edition size stated on the product page and are signed and numbered by the artist.

Paper size, image size, border dimensions and presentation details are stated on the relevant product page. Minor variations may occur because of paper trimming and the specialist production process.

Prints are supplied unframed unless the product description expressly states otherwise.

Customers should handle fine-art paper carefully and arrange suitable mounting, framing and protection from moisture, strong direct sunlight and unsuitable materials.

Copyright and reproduction rights are not transferred with the purchase of a print.

17. CERTIFICATES OF AUTHENTICITY

Original artworks sold through the website will normally be supplied with a signed Certificate of Authenticity.

The certificate should be kept safely as part of the work’s ownership and provenance record. It does not transfer copyright or reproduction rights.

Signed and numbered limited-edition prints are authenticated through the artist’s signature and edition number unless a separate certificate is expressly included in the product description.

18. COPYRIGHT AND INTELLECTUAL PROPERTY

Unless otherwise stated, all original artwork, images, photographs, text, designs and other content on the website are owned by Anthony Carey and protected by copyright and other applicable intellectual-property laws.

Buying an original artwork or print transfers ownership of the physical object only. Copyright and reproduction rights remain with Anthony Carey unless they are expressly transferred in a separate written agreement.

Website content may not be copied, reproduced, altered, distributed, published, commercially exploited or used to train a commercial system without prior written permission, except where permitted by law.

The artist retains the right to photograph and retain digital images of sold artworks and to use those images for lawful purposes, including:

  • the artist’s website and archive;
  • social media and publicity;
  • books, catalogues and editorial material;
  • exhibitions, applications and educational use; and
  • the creation and sale of authorised reproductions, where applicable.

Purchasing an original artwork does not give the customer an exclusive right to the underlying image unless this has been expressly agreed in writing before purchase.

Guest essays, quotations and third-party material remain the property of their respective owners and are reproduced with permission or as otherwise permitted by law. Permission to reuse that material must be obtained from the relevant rights holder.

19. RESALE, ATTRIBUTION AND PROVENANCE

Customers are encouraged to retain the artwork’s title, artist’s name, year, medium, Certificate of Authenticity and purchase documentation as part of its provenance.

When an artwork is resold, exhibited, loaned or reproduced with permission, the preferred credit is:

Anthony Carey, Title of Work, year.

Buyers are kindly requested to notify Anthony Carey Art if they intend to resell an original artwork, particularly within the first three years of ownership. Where practicable, the buyer is also asked to give Anthony Carey an opportunity to reacquire the work on the same terms offered by a genuine third party.

This request is a professional courtesy intended to support accurate provenance and is not a contractual restriction on the owner’s right to resell the physical artwork.

Any mandatory artist’s resale right that applies by law is unaffected.

20. PRIVACY, SHOP AND PAYMENT INFORMATION

Anthony Carey Art uses personal information where necessary to respond to enquiries, process purchases, deliver orders, maintain transaction and provenance records, prevent fraud and comply with legal, accounting and tax obligations.

The online shop is operated using Ecwid by Lightspeed. Ecwid may process information required to operate and secure the shop and checkout, including customer contact details, billing and delivery addresses, order information, IP address and technical information.

Payments are processed by Stripe or PayPal according to the payment method selected at checkout. These providers may process payment details, contact information, transaction information and fraud-prevention information in accordance with their respective privacy terms.

Anthony Carey Art does not directly store complete payment-card details.

Personal information connected with orders will be retained for as long as reasonably necessary to fulfil the order, maintain appropriate business and provenance records, resolve disputes and comply with legal, tax and accounting requirements.

These providers may process information outside Ireland or the European Economic Area using the safeguards described in their respective privacy information.

21. WEBSITE USE AND THIRD-PARTY LINKS

Reasonable efforts are made to keep the website available and its information accurate. However, uninterrupted or error-free access cannot be guaranteed.

The website may contain links to third-party websites. These links are provided for information or convenience. Anthony Carey Art does not control and is not responsible for third-party websites, their availability, security, content or privacy practices.

Nothing on the website constitutes financial, legal, investment or professional advice.

22. LIABILITY

Anthony Carey Art does not exclude or limit liability where doing so would be unlawful, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • deliberate misconduct; or
  • breach of mandatory consumer rights.

Subject to those protections, Anthony Carey Art is not responsible for loss that was not reasonably foreseeable when the contract was formed or for business losses suffered by a customer purchasing wholly or mainly for business purposes.

We are not responsible for delay or failure caused by customs procedures, delivery-provider disruption or circumstances outside our reasonable control, although customers retain their applicable rights concerning delivery and cancellation.

Nothing in these Terms and Conditions removes any remedy available to a consumer under applicable law.

23. EVENTS OUTSIDE OUR REASONABLE CONTROL

We will not be responsible for a delay or failure to perform an obligation caused by circumstances outside our reasonable control, including severe weather, fire, natural disaster, war, civil disturbance, industrial action, pandemic, transport disruption, customs delay or failure of essential third-party services.

If such an event affects an order, we will contact the customer as soon as reasonably possible and take reasonable steps to minimise the delay.

This section does not remove any right the customer may have to cancel because of substantial delay or non-delivery.

24. CHANGES TO THESE TERMS

These Terms and Conditions may be updated to reflect changes to the website, business practices or applicable law.

The version in force when an order is placed will normally apply to that order. A later change will not retrospectively alter an accepted order unless required by law or agreed with the customer.

The date of the latest update appears at the top of the page.

25. SEVERABILITY AND WAIVER

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.

A failure or delay in enforcing a provision does not waive the right to enforce it later.

26. GOVERNING LAW AND DISPUTES

These Terms and Conditions are governed by Irish law.

The parties are encouraged to contact one another first and attempt to resolve any concern directly.

If the customer is a consumer resident in another country, nothing in these Terms and Conditions deprives that customer of any mandatory protections or right to bring proceedings available under the law applicable to them.

Any dispute may be brought before a court with jurisdiction under applicable law.
